Wrongful Death

"Wrongful Death" refers to the cause of action whereby the heirs of an individual killed by someone's carelessness can recover for their loss of the deceased's society, companionship,  and income. There are sometimes other items which can be recovered, but the laws in Virginia and North Carolina differ substantially on these issues.  The action must be brought by someone who has qualified as the administrator of the Estate of the Deceased.

The defendant had screwed up bad, the expert said in his report, by violating all kinds of safety regulations, and the insurance company should be prepared to open their checkbook and shell out millions of dollars to the estate of the deceased victim.  Guess what? The family of the deceased never called an attorney. The millions were never paid to anyone. That money remained and still remains in the coffers of the insurance company.
